1. What is a Legal Document Assistant (LDA) in California?

A Legal Document Assistant (LDA) in California is a non-attorney professional registered and bonded with the county clerk, authorized to prepare legal documents for individuals who are representing themselves in a legal matter. LDAs provide self-help legal services by completing forms and documents based on the client's instructions. They are not permitted to give legal advice or opinions.

2. What can a Legal Document Assistant do, and what can they not do in California?

A California Legal Document Assistant (LDA) CAN:

  • Prepare legal documents based on your specific instructions.

  • Type or complete legal forms and pleadings.

  • Provide general, published legal information that has been written or approved by an attorney.

  • File and serve documents at your direction.

  • Assist with various document types, including estate planning documents (like trusts and wills) and real estate deeds.

A California Legal Document Assistant (LDA) CANNOT:

  • Give legal advice or opinions.

  • Interpret legal statutes or case law.

  • Represent you in court.

  • Select legal forms for you (you must direct them on which forms to use).

  • Tell you what your legal rights or remedies are.

  • Engage in the unauthorized practice of law.

3. Why does the California Business and Professions Code require a signed contract for Legal Document Assistant work?

The California Business and Professions Code (specifically BPC §6410) mandates that Legal Document Assistants have a signed written contract with their clients before providing any services or accepting payment. This requirement is designed to protect consumers by ensuring transparency and clarity regarding the services to be performed, the fees involved, and the understanding that an LDA is not an attorney and cannot provide legal advice. It outlines the scope of work and provides a legal framework for the engagement.

4. What is the cost for notarization?

We charge $15 per signature/person per document. Please note that individuals acting as witnesses for a document signing do not require a notarization of their signature, and therefore, their presence does not incur an additional notary fee.

5. What are the costs for Real Estate Deeds?

Our services for preparing Real Estate Deeds start at $300, which includes the notarization fee for the deed itself. Please be aware that recording fees charged by the County Recorder's Office will also apply and are a separate cost that you will be responsible for. These fees vary by county and document type.

6. What if I need a deed prepared but am outside San Francisco or Daly City?

If you require a deed prepared but are located outside of our primary service area of San Francisco or Daly City, we are still happy to assist you! In such cases, we will deduct the notary fee from the total cost of preparing the deed. You will then be responsible for arranging for a local notary public in your area to notarize the document. We can, however, provide guidance on finding a qualified notary near you.

7. Do you offer mobile notary services?

Yes, we offer convenient mobile notary services on Saturdays, Sundays, and Federal Holidays only. Please note that a travel fee of $50 applies for all mobile notary appointments.

8. Can I schedule an appointment outside of standard business hours?

Absolutely! We understand that your schedule may be busy. If you require an office appointment outside of regular business hours on weekdays, please contact us directly, and we will do our best to arrange a time that works for you.
